Having practised business litigation for 30 years, I have developed particular expertise in post-acquisition litigation and financial disputes (enforcement of liability guarantees, price adjustments and supplements, defects of consent, etc.). I draw on my dual training in law and finance/accounting and my experience in auditing at Coopers & Lybrand, which has given me a mastery of the accounting and financial issues involved in these cases, which is essential for defending your interests in complex situations.
I am also recognised for my expertise in defending chartered accountants and auditors before civil, disciplinary and criminal courts and before the AMF (French Financial Markets Authority) when their liability is called into question. I am the author of the reference manual on this subject: “Responsabilité des commissaires aux comptes et des experts-comptables” (Liability of Auditors and Chartered Accountants), published by Dalloz. I write several columns on this topic in legal and professional journals and regularly act as a trainer for accounting professionals. In addition to legal defence, I assist accountants and auditors when they encounter difficulties in the performance of their duties.
Recently handled cases• Criminal defence of an auditor accused of failing to disclose criminal acts and breaches of the rules on incompatibilities;
• Post-acquisition dispute: support for a selling entrepreneur accused by the purchaser of fraud and breach of warranty;
• Defence of an accounting firm accused before a commercial court of failing to detect embezzlement by its client;
• Defence of an auditor before the H2A (French labour tribunal);
• Assistance to a chartered accountant in an unfair competition dispute with one of his colleagues.
A graduate of the Paris Institute of Political Studies (economics and finance section), I also hold a Master’s degree in private international law from Paris II University and a Master’s degree in banking and financial management from Paris-Dauphine University.
