Areas of Expertise

I advise French and international companies on economic law matters, primarily competition law, commercial contracts and litigation, and data protection, both in advisory and contentious matters.
I assist French and international companies in structuring and safeguarding their activities, commercial relationships and business practices, as well as in managing complex proceedings and litigation.

My areas of expertise notably include:

  • Competition law: anticompetitive practices, abuse of dominant position, cartels and other restrictive agreements, economic dependency, merger control and State aid;
  • Competition authority investigations and dawn raids, notably before the French Competition Authority (Autorité de la concurrence), the French Directorate-General for Competition, Consumer Affairs and Fraud Prevention (DGCCRF), and the European Commission;
  • Foreign investment control;
  • Restrictive competition practices and commercial relationships: : sudden termination of established commercial relationships, significant imbalance, benefits without consideration or benefits that are manifestly disproportionate;
  • Distribution and network organisation: franchising, exclusive distribution and selective distribution;
  • Commercial contracts: negotiation, drafting, performance and termination;
  • Unfair competition;
  • Consumer law and commercial practices (e.g. games, competitions, labelling, etc.);
  • Personal data protection (compliance, handling of inspections and investigations, assistance in the event of complaints and litigation);
  • Compliance;
  • Commercial litigation, notably in competition, contractual and commercial relationship matters.
Projects handled

Advising French and foreign companies in litigation relating to anticompetitive practices (cartels, restrictive agreements and abuse of dominant position) before the French Competition Authority and the Paris Court of Appeal;
Advising companies in investigations conducted by competition authorities, including dawn raids, requests for information and interviews;
Advising companies on the notification of merger transactions to the French Competition Authority and the European Commission;
Assisting companies with the notification of their mergers to the Competition Authority and the European Commission;
Advising French and foreign companies on the drafting and negotiation of commercial and distribution agreements (exclusive or selective distribution, franchising);
Advising clients in proceedings initiated by the DGCCRF, notably in relation to anticompetitive practices, payment terms, advertising and display requirements, commercial relationships and consumer law;
Advising a client active in the transport sector in follow-on damages litigation before commercial courts following a decision sanctioning a cartel;
Advising clients in litigation relating to restrictive competition practices (e.g. significant imbalance, sudden termination of established commercial relationships, benefits without consideration) and unfair competition;
Advising clients on GDPR compliance and in investigations and proceedings before the French Data Protection Authority (CNIL).

Biography

Aude Guyon holds an LL.M. in English Business Law from Northumbria University (Newcastle, United Kingdom), a DESS in European Legal Studies from Université Paris XII, a DEA in Economic Law from the University of Orléans, and a University Diploma (DU) in Data Protection Officer (DPO) Studies from Université Paris-Panthéon-Assas.
